In recent decisions (e.g., West Virginia v. Environmental Protection Agency and Biden v. Nebraska), the Supreme Court moved away from the traditional deference afforded government agencies under the 1984 case Chevron v. National Resources Defense Council - ultimately overturning Chevron in its June 28, 2024 decision on Loper Bright Enterprises v. Raimondo. In moving away from Chevron, the court has embraced the Major Questions Doctrine (MQD), wherein courts are tasked with independently interpreting laws and deciding whether an agency has the authority to act.

The National Academy of Sciences will be holding a two-day, in-person workshop on the implications of the Major Questions Doctrine (MQD) and the overturning of Chevron deference for agency decision-making. Zuckerman Spaeder partner Bill Schultz will be co-chairing.

In an ideal world, everyone would have access to affordable, quality health insurance. Clinicians would provide the care that’s needed, and insurers would reliably process and pay claims. If problems arose, laws, regulations, and litigation would ensure compliance and fairness and help protect patients and their treatment. After all, health insurance benefits are designed to help people access the care they need to maintain their health and well-being without facing overwhelming obstacles and financial burdens.

Regrettably, this ideal system remains elusive. Disparities in insurance coverage, especially for mental health, routinely force people to choose between forgoing essential care or incurring massive out-of-pocket expenses. When it comes to therapies of depth, insight and relationship, obtaining appropriate insurance coverage may be especially difficult. For those already facing mental health and addiction issues, navigating insurance denials and fighting for appropriate coverage can be a daunting prospect. When the system falls short, advocacy by patients and clinicians may be required. Yet, many clinicians feel equally disempowered and lost.

The purpose of this panel is to empower clinicians with the knowledge and resources needed to support patients in obtaining appropriate reimbursement for treatment. Drawing on their diverse professional backgrounds, panelists will identify common barriers to care, demystify the systemic factors underlying these barriers, and provide practical resources – tools, templates, step-by-step instructions – to address them.

Zuckerman Spaeder partner Sara Lawson will be an instructor at this year's Stetson University College of Law White Collar Criminal Defense Training Program. The groundbreaking hands-on training event for practitioners of all experience levels will lead participants through a realistic hypothetical from investigation to trial to sentencing.

Prosecutors and defense lawyers alike will gain valuable knowledge and skills from well-versed professionals throughout this day-long program:

    • Learn key white collar advocacy and trial skills from seasoned trial attorneys
    • Delve into a realistic hypothetical white collar case with leading practitioners
    • Discuss trends in white collar law with academics and defense counsel

This event is well suited for new attorneys interested in learning about white collar defense and experienced litigators interested in expanding their practice to include such cases. Participants will engage in opening statements and cross examination with feedback from experienced counsel and hear from panels exploring issues such as client retention, investigations, cross examination, ethics, and sentencing.

The program culminates with a dinner at which the White Collar Defense Award will be presented to a leading advocate or advocates. Stetson is partnering with the Women’s White Collar Defense Association (WWCDA) and the ABA CJS on this program; many of the speakers are members of these organizations.
